Preliminary Agreement vs. Development Agreement – the Key Difference

Although both legal structures lead to the transfer of ownership of real estate, they differ in the scope of protection afforded to the buyer and in the consequences of non-performance of the obligation. A development agreement must take the form of a notarial deed and is subject to a special statutory regime, whereas a preliminary agreement grants narrower rights in the event of a dispute.
